I am a Strata Owner, reporting on illegal practices and abuse of power from the Strata Agent FirstService Residential (FSR) strata manager Beverly Kapush and Strata Council member, Mitali Pandey.
The first associated case began on June 25th, when I submitted an email request to have a FOB key replaced since the old one stopped working.
For over a week, FSR made no responses or attempts of communication until I called and emailed again on July 2nd. Beverly Kapush of FSR responded in email claiming that she had forward the request to Mitali Pandey so she could "follow up." This email was sent on July 2nd. In the meantime, I paid the $60 fee for the new key while waiting for the follow up.
I also sent two follow up emails on the 3rd and 4th. All Beverly responded with was "thank you for the confirmation," without any further explanation on the next steps. I replied asking how do I get my new fob...?
Over two weeks after, Mitali esponded:
"... I am very hesitant to give replacement keyfobs to owners before I have explained this to them. Your replacement keyfob may be valid for only a few months if the strata decides to completely overhaul the keyfob system...."
claiming "security issues" with giving me a replacement fob, even though every single resident of the building owns these keys...
Not only that, but the bit about the "system overhaul" was never discussed during strata meetings, neither has there been any mention or notice, or trace about it in the building.
When she "agreed" to give me replacement keys, she said she had the new fob key programmed and that her husband would be home. When I went to her unit, her husband had no idea about the key!
I don't live at the building, so I had to travel there three separate occasions by Mitali giving false information.
Everything she did was beyond a doubt intentional and exploitative of her powers as a member of the Strata Council.
The replacement of the FOB key took 18 DAYS of headache to acquire, which caused an absolutely unnecessary amount of hardship for my tenant.
The second case, which is still ONGOING and an extension from the exploitative behaviors listed above, began when the Strata Council sent me a notice for short term rental accusations in July , following the replacement key incident. This is AFTER I had already sent in the form K and a check for the $100 moving in fee in April, appropriately within the deadline date. (photo proof)
Followed FSR guideline to file a hearing.
However, my request for hearing was completely IGNORED, which is an outright contravention to the Strata Property Act. Instead, they sent me a letter 45days later to send in another form K within 7 days and a mention of a $50 fine.
COMPLIANTLY, I sent out a second form K with another check 3 days later on September 1st, as well as an email clarifying.(email to prove this)
20 days later, they completely ignored and evaded anything I submitted or requested AGAIN, and proceeded to charge me a fine of $200 instead, with no explanation nor contravention! JUST the payment procedure. They CASHED IN my original check one or two days later, yet they DIDN'T removed the illegally imposed fine!
The extent of corruption within FSR and the Strata Council at this building is beyond excusable nor tolerable. This is not to mention all the other strata owners of the building who got fined thousands of dollars every year. I wonder why the building is going through a lawsuit right now?
Not only did they a fabricate a contravention with made-up dates and fines, illegally dismiss my request for hearing, they even CASHED IN MY CHECK while telling me they had not received it!
FSR was irresponsible for my mails and delayed my response to council also provided dishonest.
The Strata Council members have been known impose their own complaints, based on personal motives of collecting fees. I wandered why owners of this strata had been charged thousands of dollars evey year.
