Pam Beck represented the seller of a duplex that we acquired in our LLC in September 2019. That seller committed fraud and she assisted the seller in doing so according to our legal complaint. We are also filing with the BBB and the Wisconsin Assoc of Realtors for an ethics violation.
The seller and their agents did not disclose material issues with the property, including but not limited to the roof having completely failed, the ceiling in the upstairs unit completely falling in as a result of the leak to the point that the upstairs unit is uninhabitable, mold developing due to long term water in the roof, and a major leak in the bathroom shower that not only has destroyed that shower walls, but leaked downstairs to damage the downstairs, as well. Estimated damages are $30,000-$40,000 on a property that was purchased for $82,400.
This damage had been occurring for at least several months and had been documented by the tenant. Worse than just withholding information, the seller and their agents lied in an attempt to cover up the condition of the property in order to commit fraud. When our general contractor and broker went to inspect the property, they were shown the downstairs and told they could not see the upstairs unit because the tenant was difficult and would not allow us in, which was in fact a lie.
These facts clearly indicate there was fraud and we would never have entered into the contract were it not for the fraud.
Not only did Pam not disclose these issues as required by contract, by code of ethics of real estate organizations, and by law, but she actively stymied attempts to get in touch with the seller and refused to provide contact information even once proof of the fraud occurred.
Further, we later found out that neither Pam nor any of the agents in her employ did a walk through of the property to inspect it, as required. In fact, she was combative and hostile towards our attempts at resolving the issue. It is our view that she should not only be sanctioned, but should not be permitted to be licensed to practice real estate.
