Got into a accident with one of their insured driv...

Got into a accident with one of their insured drivers his fault got the police claim and its been one month without them calling me or telling me any information about the claim finally called and had to wait hours when i ask whats going on with the claim they respond with the claim
Will have to be denied because we cant get in contact with the insured driver how can they not get in contact with their own insured driver, so they are gonna deny the claim because of that?? Just unhelpfull
