I purchased a new town house in Paris Ontario in 2018 and did an interim closing on October 2019 and the closing was done in March 2020.

During the PDI I noticed that the garage man door had a deck on the garage side due to the grading and extended into the garage to accommodate 4 steps. I was told that they had to do this to get the occupancy from the city and that they would change it once the occupancy was given.

I started following up with them since the closing and they did not pay much attention to the various emails I sent to them. The wooden deck in the garage extends out making it impossible to park a car.

I then raised the issue with them again and the city during which time the builders warranty coordinator offered a settlement to keep the steps as is for which I said, I am not looking for a monetary settlement but be able to park a car and instead of an extended deck, place 4 steps in the garage.

A couple of weeks ago, they sent me and also some other unit owners an email saying that the city wants to close the man door to the garage. Email copy attached:

Then two days later they sent me another email saying they will give us $300 and leave the door in the house to be used later if we want.

I feel I was misled by the builder and the city favored the builder and that they did this to get the occupancy. Now that I started raising the issue with a copy to the city they are changing their position.

The Builder should have known this before the closing and the city before granting the occupancy permit. They cannot say that due to an error we have to make changes to the garage access after 5 months of closing.

I have already rented the house and it is a great inconvenience and a loss of property value The Builder should make changes to the grade at this point and the city should make an exception and force the builder to rectify rather than close the Garage man door.

Stay away from this builder!!
