As a visitor to Schindler MAN, I was warmly welcomed and felt very comfortable.

For months we have problems with the almost new lift

My name is Dmitriy Shapoval and I am a barrister from Ukraine. At the current moment my client (Private company TRK Ros Telecom) has an unresolved legal dispute in one of the commercial courts of Ukraine.

The circumstances of this case relate to your product, as the subject of the dispute is a violation of the obligation to deliver Schindler brand elevator.

My client desired to purchase and install the elevator precisely from Schindler as from the leader in the field of elevator and escalator equipment. To do aforementioned, he, in 2015, turned to Ukrainian office of the company, which is located in Kiev. During the negotiations, the management of the Ukrainian office insisted on that delivery of the elevator would not be carried out by Ukrainian company (SCHINDLER Ltd), but by an agent BC Fisher Ltd. At that moment, the client did not attach any importance to that fact, although, he was somewhat surprised by the presence of third-party company in relation with the Ukrainian Schindler office.

Further, BC Fisher Ltd did not fulfill its obligations to deliver and install the elevator to my client, which subsequently resulted in 3 (three) court proceedings which were initiated by my client. In some of these cases, SCHINDLER Ltd acts as a third party, in other cases company employees acts as specialists in conducting judicial actions and also they participate in conducting investigation actions in criminal cases.

Common thing of these cases is the presence of an agreement between SCHINDLER Ltd and BCFisher Ltd concerning the delivery and installation of the S3300 elevator (Agreement No 1115041 as of 18.09.2015). Under this agreement BC Fisher Ltd purchased aforementioned elevator from SCHINDLER Ltd for UAH 762 216 and the services of its installation by SCHINDLER Ltd on the order of BC Fisher Ltd cost UAH 72 000.
Further, the same elevator was sold by BC Fisher Ltd to my client at the price of UAH 961 228, 51 and the same services, which my client expected to receive directly from SCHINDLER Ltd, were cost UAH 85 000 id est the difference between direct purchase and installation from SCHINDLER Ltd and the same services from BC Fisher Ltd, which were imposed by the Ukrainian office of Schindler, is following: UAH 199 012, 51 on delivery and UAH 13 000 on services.

This difference raises, at least, doubts in the reasonableness and competence of the actions of the management of SCHINDLER Ltd, which resulted in loss of more than UAH 200 000 by my client, although, there absolutely was no need to involve BC Fisher Ltd, because my client turned to and wanted to get the services by the Schindler company level.

Instead, the result of my client`s appeal to Ukrainian Schindler office became the existence of 3 (three) court proceedings in the frames of which my client is trying to recover almost UAH 1 500 000 from the imposed BC Fisher Ltd for an undelivered elevator and unexecuted work.
Taking into account Schindler s reputation and world-wide level of service, I, in the interests of the client is have a request to you to clarify the situation regarding the powers of the management of the Ukrainian Schindler office in September 2015 to attract the BC Fisher Ltd to give services to clients.

I am thankful in advance for your help and express full confidence that, despite the unpleasant accident with the Ukrainian Schindler office, the global reputation of the Schindler brand still arises respect from my client.

For a clearer understanding, I enclose copies of the aforementioned Agreements.

Please look into your australian operations. We have 20 floors being serviced by 2 broken lifts which they cannot provide ETA on technician because the heat cause other lifts to breakdown.

Heat in summer is common in australia. Trying using google or bing or a rock, it will tell you australia gets hot in summer.

So resource apporpriately and train your staff correctly.

I work there so I'm kinda biased. But tp be honest it's a really good company. psst..buy our elevators
