Management clearly does not understand the LAW on late fees in TEXAS and corporate either does not know or care about being fined. They will, and continue to charge late fees AFTER you have have paid rent in full if you still owe late fees. Its known as "monetary hijacking" They simply do not deposit your rent until you pay late fees still owed, thus continuing to increase the amount owed daily with late fees. This is ILLEGAL. Late fees can only be charged on the outstanding balance of the RENT. You cant charge late fees on a balance of late fees. It would be like paying your credit card bill down to zero but the credit card company does not post your payment so they can continue collecting interest. Not only is this law just plain COMMON SENSE, it is clearly spelled out: "In the state of Texas, a landlord may impose the full amount of the daily late fee, not to exceed 5% of the total rent amount, until the rent has been paid in full. At such time as the rent has been paid in full, the tenant is still liable for the incurred late fees, however any additional daily late fees must cease.
