On 11/1 at 2 AM, Ashley's Towing performed an illegal inspection of my automobile in an attempt to establish a violation that would justify their confiscating my property. They are claiming that the HOA authorizes them to essentially violate my 4th Amendment rights. Additionally, In the process of the unauthorized inspection, Ashley's Towing caused damage to my vehicle.
Ashleys Towing is claiming that they inspected my vehicle on 11/1 at 2 AM and determined that it was leaking fluids and is unsafe or wrecked. A member of my household drives this car every day to pick up my daughter from school, so it is not wrecked, not unsafe, and not leaking fluids.
The person I spoke to at Ashleys Towing told me that their employee sent photos of sections of my vehicle to the HOA. These photos would have been of sections of my vehicle that are not visible to a person walking past it. Is this true?
On the morning of 11/1/2024 at 2 AM, Ashley’s Towing Service engaged in an unauthorized interaction with my legally parked vehicle in front of my residence, displaying all required tags and registration. Without my consent, an employee of Ashley’s Towing moved my vehicle and performed an inspection of its underside, photographing it without permission. This inspection, purportedly conducted to identify a possible violation, breached my privacy and violated my reasonable expectation of privacy, as my vehicle was legally parked in front of my home.
During this unauthorized inspection, Ashley’s Towing Service caused damage to my vehicle due to reckless handling and a lack of proper care, which I did not authorize. Their careless approach could potentially qualify as vandalism, as they acted negligently, causing damage while interfering with my property. This disregard for my vehicle’s condition demonstrates a lack of respect for my property rights and could be seen as a form of vandalism under applicable laws.
