As the Insurance Expert on the file, I sat in on the mediation of a long term disability case and watched Howard Blitstein explain the case to the mediator and discuss the merits (and weaknesses) of the case with his client.

He and the client agreed on the value they thought they should bargain for and also agreed on the rock bottom value they would accept.
The mediator shuttled back and forth with offers from the insurance agent (who was sued for his negligence in completing the application form) and the insurance company (who was sued because the contestability period had expired).

Howard Blitstein was able to raise cogent arguments against the allegations from the other side and eventually (supper time) they folded and the client was offered the full value she was looking for.

I have worked on many meditations and this was the best example of fine lawyering I have ever seen. At times Mr. Blitstein was quite firm with the mediator, urging him to push harder on the other side.
