I entrusted Foley Carrier Service to ensure all health and drug testing requirements were fulfilled for my employees. Prior to my DOT audit I had a two hour meeting with Foley representative Kristy Krajewski, where we went through a step by step checklist to ensure I had everything the DOT would expect during the audit.

Upon completion of the audit I was found to have four violations involving either directly or indirectly drug testing and driver files, both of which were to be managed by Foley on my behalf. I emailed the report to Foley team leader Scott Mogensen to find a resolution. I was assured that none of the violations were due to services that Foley was charging my company for. I could not get a logical explanation as to why these violations were not covered by Foley, just that they were not responsible for them. I was left with the feeling that had I been found to have 100 violations Foley would not have been responsible for any of them either. I am left wondering what I was paying them for all these years, to which they did not have an answer to as well.

As a small business owner I depend on companies like Foley to ensure that I am in compliance of all applicable laws and regulations. I also gladly pay them handsomely for the service. My expectation being that, in this instance, I am in compliance with the DOT, as it turns out I was not. After discussing with several Foley representatives it is obvious they are not concerned with ensuring the compliance of their customers or the safety of others on the roads. I encourage everyone required to have a DOT compliance program not to use Foley Carrier services they are only interested in invoicing customers, not providing service.
