I purchased a 2017 Jeep Grand Cherokee at the end of May this year, at Courtesy CJDR in Tampa, FL. I put down 70% and financed $18,000. I handed the draft to George and got a copy of the front and back, with the verification code on the check filled in.

Two months later, I get an email (not a phone call) from George saying it was lost in the mail. He implied that the check was sent back to the credit union to cash it. In a phone conversation with Brandon Leiss, he told me that it was sent to the credit union electronically and, somehow, they did not receive it.

In a phone conversation with Antonio, general manager, he stated that the draft was shredded accidentally by an employee who worked in accounting. I called the credit union and they told me I had to re-apply for an auto loan to get a new draft. I would not be guarantee the same interest rate and the application would hurt my credit score. The credit union said if they contacted me two months ago, before the draft s sixty-day expiration, they would have been able to print me another draft.

Why they waited to contact me until Aug., after handing them the draft in May, I do not know. I asked for a reduction on the draft or to return my down payment back. They originally offered $500 off, which shows they do not understand the severity of the situation. Antonio kept stating that the draft was not money, that it was a small mistake, did we really want to punish them over a small mistake, that they had a right to repossess the vehicle and Brandon told me that the vehicle was not ours.

Antonio stated that in order to get a deposit back, they would have to subtract fees because I drove the vehicle, subtract mileage, and inspect it for wear. They are seeking to deduct money from our deposit to compensate for the two months they kept silent about their error and to compensate for the mileage.
