Ben Heisler is a professionally unethical agent who kept up a running dialogue with my agent all weekend and specifically stated that I had the highest bid and also clearly stated that the deadline for submitting contracts to the sellers was 8:00 pm Sunday night. He assured my agent he would be honest with us, which he wasn t. I initially offered 20K, then upped it 5K more and was expecting either a yes or no to my offer. If the honest answer had been no that would have been the usual kind of upset or disappointment one can expect and can deal with in life. When my agent called me at 8:22 and told me he had received a call from Heisler and that 3K more was demanded by the sellers and that then the contract would work and the contingency on the sale of my house would be accepted with the additional money we were ecstatic since I agreed to the additional money.
But then with a blatant lack of a moral code and integrity, he went back on his word. The contingency was never an issue and even now I see it listed as Contingent. What I suspect happened is that Ben, after apparently accepting my contract, used it to entice another buyer to up their bid. Or was unethical in failing to tell anyone else that might have submitted via phone call later that night that my contract had already been accepted verbally. Either way, the actions, while not illegal, were certainly unethical. And certainly caused us personal distress. Don t take advantage of honest people who take you at your word. That is just plain wrong. A man and his reputation is only as good as his word.
