If one person reads this, my effort is worth them ...

If one person reads this, my effort is worth them living through the huge amount of stolen money, forced to live in an unsafe apartment, continued abuse and discrimination against a 78-year-old man with a disability. Their license should be removed, particularly my agent, Nicholas Soto, who did not ever follow even one, law or Ethics standard.



I rented an apartment at 509 Aceqia Madre in Santa Fe, New Mexico for the first quarter of this year from Casas de Santa Fe from agent Nicholas Soto, the person that committed the crime and stole $2000 from me by the illegal and unauthorized use of my credit card.

 Since that time I found I was also charged a “nonrefundable $1000 deposit” which of course I never knew about since I never saw the lease until about a week ago.  This is not only despicable, it is mind blowing I also found a $1300 unidentified charge in February 2025. I have asked at least five times to those who say I was harassing them, and specifically, Rebecca, the manager, Nicholas Soto, my assigned agent, and Todd Davis, the owner for an accounting of every penny that I spent with them. I haven’t received that and they have not even acknowledged my email requests.  Some of the emails to them were for this or some other important information related to their theft, but rather than work with me like maybe a binding arbitration, Casa de Santa Fetook the weak way out, a very cowardly thing to do… they called the police and said I was harassing them and the officer talked to me very strongly because Casasde Santa Fe lied to him about the lease. Apparently Casas de Santa Fe don’t have the wherewithal to hit the delete button or to block my emails. So it was a false report to the police.

They lied to the police, and they lied to my credit card company regarding the lease, which I never had,and  I never signed.

All I signed was a one pager and it didn’t even have the name and address of the property I was about to rent,which is probably some kind of crime or misrepresentation on their part.  I was not given anything regarding details and rules of the lease, and this can be proven because they did not follow the standard practice of having you sign or initial every page of the lease.

After I exited the apartment I got a letter from Nicholas Soto  that said there was some damages totaling $2000 and they were going to charge it on the card that I use for the rent. I very strongly and explicitly said in two emails that they are not authorized to make this charge,we can talk about it, but they are legally not allowed to make the charge on my credit card.    After warning the real estate agent, Nicholas Soto, two or three times then Nicholas made the illegal charge on my credit card. 


Nicholas Soto, office manager Rebecca, and business owner Todd Davis have refused to give me my money back. They have never returned one email.  They have stolen my money. 90% of the things on their damages list were not true and they couldn't prove it because they had no pictures before I moved in, something that other credible agencies demand. Therefore, if there is no information on the condition of the apartment before I came in, another standard procedure for real estate management companies, they cannot possibly attribute any damages to me when there have been dozens of tenants before me. It is an outright lie, and frankly, I think think they should be investigated for this type of billing because I think it might be a scam and they do it over and over on the same properties. 


There are other ways to resolve a conflict other than illegally charging somebody for something. By the way, when I looked at the list of items, they were preposterous, absolutely preposterous, and there were no pictures of the condition of the apartment before I moved in. This is just either on purpose or they are lazy because the apartment is only 800 ft.², so how long would that take?  In my current place, I had to take pictures before I moved in. Also, the lease was 50 pages and the property manager went through every page and had me sign each page or initial it. Also, they took out one page that I objected to  There are not many good reasons that Santa Fe doesn’t do this, This is standard practice with a dozens of rental agencies in town

 I rented two properties to Casa de Santa a house and a condo several years ago and I challenged the owner Todd Davis if he saw evidence of me trashing my property. Of course, like every other attempt of communication, I got no response. 

I just want my money back and I’d be glad to have discussions about the items they have and if they don’t like it, the recourse is not to make an illegal charge to my credit card, actually it’s a theft, but they can always file in a small claims court 

What I got when I signed a one pager that did not refer to the lease ,was one page That didn’t even have the name and address of the property on it I remember this clearly because I needed to show to the post office to change my address And when I took it there, they said it was no good It’s the only page I signed and which I think might invalidate everything, it did not list the property address. I had to go back to Nicholas Soto three times and he printed something off the web that gave me the address, but I never got the lease until several days later, after it was too late, but I certainly am not responsible for living with the lease  IF I HAD SEEN THE LEASE WITH ITS DRACONIAN TERMS I WOULD HAVE NEVER EVER RENTED THE PROPERTY, THE WHOLE THING WAS A SET UP TO BILL ME FOR CHARGES I WAS NOT RESPONSIBLE FOR.  THAT’S WHY I THINK THERE SHOULD BE AN AUDIT OF ALL THEIR BILLING BECAUSE THE WAY I LOOK AT IT AND THESE TYPES OF THINGS, I’M NOT THAT UNLUCKY. I CAN’T BE THE ONLY PERSON THAT THIS HAPPENED TO.  

Nicholas Soto made some statements saying he just remembered what the unit looked like before I moved in.   Well, he probably has 20 units, so can he remember the exact inside before every tenant goes in there?  Does he have a photographic memory? I doubt it otherwise he wouldn’t be doing what he’s doing now. Plus if he was doing his job, he should've reported the four very dangerous Code issues, particularly after I pointed it out to him, But he never remembered or blatantly ignored what I told him about the safety

They broke the law, they committed a criminal offense against me ,they stole for me, and they refused to give my money back

Additional information when I moved in, I alerted the Nicholas Sototo four very significant safety issues, causing me to fall several times and get burned on an exposed heater. I reported this as a courtesy , but they did not answer and they have done nothing so I have reported them to the licensing and Inspection people in Santa Fe. I've built several houses, I'm certain that these are Code violations. The worst case is a step that is several inches lower than it should be entering from the outside gate and it is totally dark there at night. The small lights in front of the entrance door do not reach to the dangerous steps.    Someone is going to fall hard and crack their head against the flagstone.  For older people or children I recommended to the real estate agent Nicholas Soto that he not rent to anybody because of the serious safety issues. 

The law says that if you just sign a sheet of paper but don’t have a lease attached that you have to at least reference it in the paper that you sign. This didn’t happen and as I mentioned, it was six or seven days after I signed the one pager that I receivedthe whole lease, which I asked for many times and it was like pulling teeth to get it. It was not valid. It had no address and there was no reference to an attached lease, And they did not do the standard practice of me signing or initial each page of the lease, which makes it invalid and then they came up with the lease to lie to the police and the credit card company. They said I did sign a lease, Which was a lie to the credit card company and to the police.

I have given con State, Santa Fe, 54written letters requesting my financial records, and they have broken the law again by refusing to give them to me each time
