BUYER BEWARE! We bought a spec home from Kimberley Development a few years ago. We had to sue them because of the severity of the issues with the home. The final judgement was over half a million dollars, but it wasn’t even close to our repair estimates. On top of that, we had to pay for Kimberley Development’s legal fees even though they were found negligent, so it cost us over $200k to sue them and win.
Also, buyers should be aware that their contracts include a mandatory arbitration clause, which keeps disputes out of public court records and makes it difficult to see how many claims or lawsuits may have been filed against them over the years.
