It is difficult to convey my appreciation for the tremendous representation Markovits Stock & Demarco provided my small company in an Antitrust suit against a large ex-Fortune 500 Hundred business that was attempting to force my company out of a market we d been in for 20 years. It s fair to say it was a David versus Goliath conflict against a large well known New York & Washington law firm. Bill Markovits lead the effort, but everyone in the firm was involved.
The lawsuit was stressful and expensive, although my best guess is that our representation cost a fraction of what the large New York firm cost our large ex-Fortune 500 Hundred competitor. What I remember most vividly from the ordeal wasn t just the excellence of the representation we were given, but the compassion of everyone from the firm. At no point did I feel as though anyone at the firm had anything but our best interest in mind. They understood and made allowances for the stress I was under as the guy who saw the business he d built out nothing being unfairly threatened. They gently coached some of more nervous and excitable employees through their depositions giving them the courage to hold up under questioning from opposing counsel.
All that being said I would be remiss not to highlight the firms actual representation during the preliminary injunction hearing. Bill, Terry, Paul and the rest of the team did a great job of representing our side, and compromising the other sides witnesses. We were granted the preliminary injunction and it held up on appeal.
I will give one other comment about the firm. The other side appealed our preliminary injunction win. Bill called me and told me he d gone overboard on his hours preparing our response to the appeal and only wanted to charge me for the excessive hours if we won. I pointed out that I was a client largely because of his tendency to go overboard in his work for us. However, I agreed with his deal, but insisted that, if we won the appeal, he d increase the charge for the excessive hours he put in. As I hung up the phone I laughed at the irony of having a conversation with a lawyer where the lawyer is essentially wanting to charge less and the client is arguing they should charge more.
