What happened to my 90-year-old mother was not only "bad lawyering."
It was retainer-bait, scope-switching, and financial extraction. Daniel Zahn, a.k.a. Dan and Dan Esq.'s behavior was not only egregious, it was unethical and merciless.
I am in possession of videos, audio, and written statements, as are legal authorities, many of which have been proven to be false. Mr. Zahn held my mother hostage over eight years after assuring her that he would "Get back most if not all the money paid to the first lawyer," who he insisted, "was churning the files and using my mother as his very own piggy bank."
The charade went on until the end of my mother's life at which time he continually reminded her of her impending death. Before this time, he worked through me, though I was not the client. It was cruel and merciless especially after gaining trust just like the first lawyer who he would consistently refer to as a swindler.
He called my mother "Mom," all the years, and never sent a bill, only calls to me, sometimes urgent and hysterical calls, that I need to tell my mother to write another check in the amount of $15,000, $12,000, $15,000... over $100,000 and never returned one cent from the first lawyer.
The case remains in the court eleven years later, though it was not filed until three years after he was retained, all the while collecting an elderly widow's life savings.
When I caught on that something was very wrong, he left a voicemail for my mother not to trust me, only him. This is known as grooming as well as exploitation.
His "client" who he only talked to about the weather and how he wanted to protect her, was instead taking from her. She had no idea until it was too late.
Still advertising in Holbrook, New York, from what he said all the years is that he is retiring, currently licensed in Vermont, with a new photo with subdued lighting, giving the impression of days gone by. My mother would "trust" this image which I am sure is the idea. Over the years the goal was to live in Montana with his paralegal who turned out to be his realtor. After telling me what he is doing will never work because, "It is the big boys' club," she was gone.
Before a case was resolved that I finally called the defendant against Mr. Zahn's advise, settled what he would have kept going ten more years. He canceled the settlement conference, left New Hampshire to work under his cousin, an attorney in Keene, New Hampshire. He took more than full payment because he said he found old bills that he never told my mother about, "on post-it notes."
An additional $60,000. My mother who was due to receive less than paid over ten years and never received the reason this "attorney" was hired, did not receive the check. Mr. Zahn sent it to the wrong address three times. He would laugh when I called for a tracking number. It took four months to receive the check.
Because he left for New Hampshire without making sure all was in order, the defendant, after ten years of being the defendant, became the plaintiff by filing a lawsuit against my nearly 90-year-old mother. She wrote a letter to Mr. Zahn which is heartbreaking to read. She wrote, "How could you do this to me?" It was the final assault. She never recovered.
Mr. Zahn's new business registration is listed as "foreign." Perhaps it is some sort of protection after changing the payee on the checks my mother wrote to him, while adding information in the memo. I discovered this years later, was too late to report to the Department of Securities and Finance.
It is a tragic cautionary tale as my mother lost her life while being taken advantage of by Daniel Zahn and five other lawyers. The realtor was right, she didn't stand a chance.

There was no office in E. Setauket and no longer in Remsenburg advertised "cash only" For Sale by Owner, was in pre-foreclosure. Two clients, my mother the only paying client.
The reviews posted all at once is an attempt at risk management. There was only one other client aside from my 90-year-old mother. She was the only paying client in the previous decade according to Daniel Zahn's own admission.
