I got hit by a Gainsco insured driver several months ago...the initial repair process and service were fine. I picked the repair shop, "cosmetic" damage necessitated a door panel skin to be replaced on front/back passenger's side and Gainsco paid the bill.

I was planning to sell the car prior to the accident and had been offered $22-23K by several dealers, now I'm being offered $19K or less. I made it clear to the Gainsco staff that I wanted Diminished Value. They told me they would process the DV claim after all the repairs were done. The rub?! The guy I was sent to that "handled DV claims" said he'd be in touch, 2-3 weeks later nothing. He finally calls me, after my persistent chasing, to tell me that it would take 6-8 weeks to process the claim because he's the only one in Gainsco that does it. Months went by, I left voice messages, texts, nothing!

Yesterday, I called his supervisor and surprisingly, the adjuster calls me today and says..."we're not obligated to pay DV claims, so we're denying your request." Why was I told throughout the process, it would be handled afterwards? Why did it take MONTHS to come to that determination.

They turned a good experience into a pain the butt experience!

The adjuster just called me today and said they won't pay what I'm entitled to under Texas Law.
