I came here to record a self tape and wasn't too impressed. One of the concerning things i encountered is how they advertise that they are looking for "interns," and say on their website that interns operate day to day activities, do self tapes, and other regular business operations.

I have a bunch of attorney friends, of whom all have agreed that it indeed is illegal to have interns serve as a primary labor source, instead of legally hiring employees..

Actor Company's website says: : "Intern duties include: being knowledgeable about the services we offer at The Actors Company, taping and editing auditions, answering the phones, greeting guests as they walk in, responding to emails, social media assistance, organizing class lists, running errands, making phone calls to actors, assisting in classes, during festivals and at company events, and generally helping out with our day-to-day operations.

Analyzing the "discretion and independent judgment" factor, you can easily determine labor laws are being violated. Factors to consider when determining whether an employee exercises discretion and independent judgment with respect to matters of significance include, but are not limited to: " (1)whether the employee has authority to formulate, affect, interpret, or implement management policies or operating practices;
(2)whether the employee carries out major assignments in conducting the operations of the business;
(3)whether the employee performs work that affects business operations to a substantial degree, even if the employee's assignments are related to operation of a particular segment of the business;"
