Contrary to what JK D says in his critical review, you do not need to file any charge with the EEOC to be able to sue your employer for alleged discrimination. There's no guarantee the EEOC will find probable cause that your employer did discriminate, so if they don't, that actually works against you if you file suit after that.

Instead of assuming things about a subject you're not informed about, consult an attorney. There's lots of them who work only for plaintiffs, and most, if not all of them, will tell you if they think you have a case you can win, for free.
