Throughout early 2017, my partner and I made plans to relocate from Ohio to Houston Texas. A relocation company provided us with our realtor, Benjamin Blewitt, a realtor for KW Memorial. Being first time home buyers, it was really important to us to feel comfortable during the whole process. Ben included us in group texts after we had decided on our home to choose our home warranty company, which he had explained was going to be paid for by the seller of the home. Great we thought, and chose our company.
At closing we sat down with the Title Agent and Ben and began signing the pages upon pages of documents. Three months into home ownership, our AC system required full replacement. We thought back to the home warranty and I pulled the pamphlet from our closing documents to call. On the phone with the home warranty company from the pamphlet, they told me we did in fact NOT have a home warranty with them. Being the summer, we did not have time to think about what home warranty or if we had one to begin with and had to pay $10,000 of our own money to fund the replacement.
Going through the closing paperwork and documentation at a later date, I found that the home warranty company, which would have replaced our ac system, was a different company than not only the one we chose (which I have documented) but also different from the home warranty pamphlet provided to us at closing. Our closing documents show one home warranty company on one page and a different company on another. While we reviewed the closing documents, we did not see the change in such voluminous document, nor was it pointed out to us. I contacted our actual home warranty company after the fact, and not surprisingly they will not honor our claim, despite the circumstances.
I contacted Ben to tell him how upset I was and how I felt misled as a consumer. He would not take any blame for any of the actions. I told him I was recommended to take legal action, which I since have. My attorney sent Ben a letter of intent with no response, so I m hoping to receive what I have been seeking; a resolution for the money and time his negligence has caused.
