We purchased a property that had tenants in Heating was broken before we moved in and Agency Kiara Porra and Don Hanlon, Jason Birch are the guilty parties involved. below is a email I sent in after numerous requests.

Nathan has visited and advised the fan has gone and been broken for quite a while! His words exactly

Proves your PRD report is incorrect ( that all is in good working order when we picked up the keys!
Monday the 21/01/19, you spent over a hour in our unit trying to get the heating to work and liaising with staff from PRD via tele, your next response
o Advised us you would seek tradie etc.
Next response from you was I had to seek legal advice regarding this,
Our meeting with Don Hanley and ourselves 24//01 you stated in the meeting
o the previous tenants had no issue did you even question them?
o also stated in the meeting between Don and myself that you did not check the heating?
o Who did the final inspection?
o Final inspection or handover not received by us, so we could identify the issue with all parties present so no misunderstandings could occur.
o Rental Property Team should be paying for this oversight before handling over to the Sold Team
o Don Hanley advised during the meeting I cannot sue them? (Defensive response)
o As advised by our legal advice
The agent should have been there to assist in checking before you took possession of the property on that day ( for discharging of there legal responsibilities).

Previously stated to my conveyancer dated 22/1 that Gary and I were happy to settle as long as the heating issue was resolved!

I have had to chase every query and email regarding this issue, prior to having this resolved before our settlement date.
o Which did not occur!

As per Consumer Affairs/VCAT our lawyer, who advise there is a case to answer this outstanding matter has now been escalated.
o Through the relevant authorising bodies.
