My company bought two containers of popcorn kernel...

My company bought two containers of popcorn kernel from Shallowford Farms Popcorn to export to customers in Vietnam. The first order was in May (arrived in Vietnam port on July 30th) and the second order was in July (arrived on August 5th). Both containers arrived with kernel filled with weevils and mold. My customer in Vietnam hired an independent auditor from Vinacontrol to come to inspect the goods. After discussing with Shallowford Farms Popcorn, they agreed to reimburse the first order only (no reimbursement for transportation and taxes included). However, they refused to reimburse the second shipment. The reason they gave us is that During the summer months there is no way to guarantee loads that stay on the water for more than 30 days free of infestation . I was so shocked by her email indicating that they are unwilling to reimburse our company for a shipment of weevil infested product you shipped under a 1 year warranty, that molded in less than 60 days. Despite her altering her warranty policy, she was aware that the product was shipping by vessel to Vietnam, because she even recommended the freight forwarder for us to use. She also knew that the shipment she made available for pick up in May and July would be traveling during the summer months. All of this was known to her company prior to shipping and at no time did she tell me that the 1 year warranty was being altered by her company. Instead, she assured me that the product would be fresh, took my money and provided product. We also used a second reputable carrier for the second shipment, with exactly the same results -- weevil filled and moldy popcorn. My client's company has lost far beyond the cost of goods, as they have incurred shipping, taxes and import costs on the kernels that are not salable to the general public as she was aware of. I am attaching the report from the inspector in Vietnam indicating weevils and mold in every bag inspected, and was consistent on every bag in the shipment, despite my company following protocol for shipments of food overseas.
Shallowford Farms Popcorn is no longer responding to any of my emails now. BEWARE OF IMPORTING POPCORN KERNEL FROM THIS COMPANY.
