If I could give zero stars I would. The OAH does hearings for the MIA in the appeals process. They allow insurance companies to get away submitting evidence late , delaying tactics, and make someone who is disabled sit in a hearing for 5 hours with no break to only continue to another date because the insurance carrier did not submit his paperwork on time . Allow them to participate by phone and who knows who is helping them on the other side of the line. When calls get disconnected they attempt to call them back over and over again delaying and taking up more of your time. If an insurance company chooses to participate by phone then they take that chance if they become disconnected they are done. This would never fly for us as homeowners. Numerous claims against insurance carrier usaa yet they have not been filed against for violating code. Does evidence even matter anymore? Is there justice for the little guy? Who will stand up for the homeowners against the corrupt insurance companies who make you fight for what you have already paid for. MIA and OAH are suppose to be there to help you but they don t help you when you file an expedited claim and it takes over 8 months for them to make a decision and despite the evidence rule in an insurance companies favor not because they did not handle the claim correctly or that the insurance carrier is wrong but by their interpretation they did not violate code. That s all they rule on is code not whether they are right or wrong but only what benefits the MIA by being able to fine them or not. So really what is the point ? An insurance company can mishandle your claim, label the scope wrong but the MIA and OAH cannot help you because they do not rule on those types of things only if they violated a code. Again why do they even exist if only to help themselves and not the community.
