What a terrible experience trying to cancel a contract without penalty even though it is a legal right based on the Canadian Code of Conduct - First Data seems to think they are above the law! Many, many frustrating phone calls later and I've got no where... they will not provide their affiliate (First Data Global Leasing) with documentation to prove we were within our legal rights to cancel without penalty. And the people in the company that should be assisting with the matter seem to refuse - they leave it to the junior customer service representatives that have no clue how to explain to me why First Data does not have to follow the law or transfers you an automated phone system that takes you no where! They can only apologize and say there is nothing they can do.

BE AWARE - The Canadian Code of Conduct States that "Merchants are allowed to cancel their contracts without penalty following the introduction of a new fee, a fee increase or when a reduction in applicable interchange fees is not passed on to the merchant." "Merchants have 90 days from the date they receive the notice of the new fee or fee increase to cancel their contract without penalty."
"As part of this right, merchants cannot be charged penalties for any related service contracts with payment service providers, such as terminal leases or third-party payment processing."

First data documented that we told them the "reason for cancellation" was that we switched service providers and will therefor not assist with cancelling our terminal lease without penalty. We did not know that we had to site the Canadian Code of Conduct for them at time of cancellation. Is this not ridiculous?? Any reputable business would assist their customers based on their LEGAL RIGHTS - It should be MANDATORY that they check if we were within our rights to cancel and act appropriately.
