Apparently this DA office is not in favor of enforcing gun laws in Texas. In October 2016 salvador ortiz jr shot a man down the street from his house in the back and then claimed self defense because he stated he shot the man in his garage while lunging at him and claimed burglary of his detached garage in the back yard . The sheriff dept. Failed to run ortiz's criminal history and find out he was a convicted felon for federal drug trafficking and possession charges and on parole and legally barred from possessing a gun. Today after another detective reviewed the case and the shooting victim trying to file aggravated assault with a deadly weapon and felon in possession charges, which the detective agreed that ortiz story did not match the forensic and physical evidence, the Kim Oggs office is declining prosecution. Mr ortiz has since assaulted the man with a knife in his car in Pasadena with no prosecution and most recently tried to do so again at a gas station in north houston and is charged with misdemeanor criminal mischief for stabbing out the man's tires. Texas statute states there is no defense to prosecution or justifiable use of deadly force if the actor is legally prohibited from owning a firearm or commits an offense higher than a class c misdemeanor in the act of defense, which illegally possessing a firearm is. There is no defense to a prohibited felon possessing a firearm. The burglary charge was dismissed against the accused man. This DA campaigns as a liberal and for stricter gun control and talks about keeping guns out of the hands of people who are prohibited from possession , yet refuses to enforce the very laws that prevent this and prosecute those offenders. Or at least it seems this is the case when it is a white man shooting a black man in the back. It would seem that black men cannot receive the same justice as white kids in Santa fe.
